§ 10-92. Fine to be levied and collected.

  • (a)

    Pursuant to A.C.A. § 16-17-129, an additional fine of $20.00 shall be levied and collected from each defendant who pleads guilty or nolo contendere to, is found guilty of, or forfeits bond for any misdemeanor or violation in the district courts within the county.

    (b)

    The additional fine levied and collected shall be deposited into the Jail Operation and Maintenance Fund No. 3017 by the county treasurer and the revenues generated by the additional fine shall be used exclusively for defraying costs of incarceration and transportation of prisoners, the maintenance and operation of the county detention facility, the purchase and maintenance of equipment for the county detention facility and training, salaries and certificate pay for the county detention facility personnel and the county deputy sheriffs.

    (c)

    The revenue derived from the additional fine levied and collected under this section shall not offset or reduce funding from other sources for the maintenance, operation and capital expenditures of the county jail.

    (d)

    It is the intent of A.C.A. § 16-17-129 and this section that the $20.00 shall be an additional and mandatory fine and shall not be waived or reduce other fines imposed by law.

    (e)

    This section hereby amends and supersedes any and all ordinances in conflict herewith. Pope County Ordinance No. 2007-O-32 shall be deemed repealed for misdemeanors or violations occurring on or after July 1, 2009, except notwithstanding Pope County Ordinance No. 2007-O-32 shall remain in full force and effect for the assessment levy order and collection of the fines imposed thereunder for misdemeanors or violations occurring on or before June 30, 2009.
